Terms of Service & Platform Policies

Agreement to Terms

By creating an account or using KreyòlDash ("we", "the platform"), you agree to these Terms of Service and the role-specific policies below. KreyòlDash connects customers with local Haitian restaurants for food delivery, offers a Cooking Academy with AI and live cook instructors, lets students publish and sell recipe preparation documents in the Recipe Gallery, hosts professional cook partners, and runs a "Play & Win" game. We facilitate transactions; food is prepared by restaurant partners and delivered by driver partners, cooking sessions are led by cook partners or AI instructors, and game prizes are funded by entry fees. If you do not agree, do not use the platform.

Customer Terms

• Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) and provide accurate account information.
• Orders: When you place an order, you authorize payment via Stripe. Payment is held in escrow and released to the restaurant and driver only after you confirm delivery. See our Order & Refund Policy.
• Accuracy: Provide a correct delivery address and be available to receive the order. You are responsible for failed deliveries caused by incorrect information.
• Loyalty & rewards: Points and rewards are non-transferable, have no cash value, and may expire or change at our discretion. Abusing the loyalty or referral system voids your rewards.
• Conduct: Treat drivers, cooks, and restaurant staff with respect. Abuse, harassment, or fraudulent chargebacks may result in account suspension and forfeiture of rewards.

Driver Partner Terms

• Verification: You must submit a valid government ID, driver's license, vehicle insurance, and consent to a background check. Approval is at our discretion.
• Registration fee: A one-time, non-refundable registration fee is required before you can accept deliveries. Admins may waive this fee in limited cases.
• Independent contractor: You are an independent contractor, not an employee. You are responsible for your own taxes, vehicle costs, insurance, and compliance with local law.
• Availability: You control when you work by toggling your availability. You may decline jobs, but once accepted you are expected to complete the delivery promptly and safely.
• Safety & ratings: Follow all traffic laws. Your safety rating is based on customer reviews and platform checks; sustained low ratings may lead to suspension.
• Earnings: Delivery fees and customer tips are credited to your wallet. Payouts are processed per your selected method. Disputes must be raised within 7 days.

Restaurant Owner Terms

• Approval: Restaurants must be approved by our admin team. Approval requires a valid business certificate and compliance with local food-safety regulations.
• Fees & subscription: A one-time, non-refundable registration fee and an active subscription (Basic or Premium) are required to appear on the marketplace and accept orders. Canceling your subscription makes your restaurant unlisted.
• Menu & accuracy: You are responsible for menu accuracy, pricing, availability, food quality, and preparation times. Menu items must use real photos of the dishes you serve.
• Operations: Keep your open/closed status and delivery radius current. You must fulfill confirmed orders promptly; repeated cancellations or delays may result in suspension.
• Payouts: We deduct a platform commission and service fee from each order. Net earnings are released to your payout method after delivery is confirmed. See the Order & Refund Policy for escrow details.
• Compliance: You are solely responsible for permits, health inspections, food safety, and tax obligations related to your business.

Cook Partner Terms

• Verification: Cook partners must submit a profile photo, bio, specialties, and consent to admin review. A one-time, non-refundable registration fee may apply before teaching live sessions.
• Live sessions: Cooks lead scheduled live cooking sessions with enrolled students via Google Meet. You are responsible for showing up on time and delivering a professional, respectful session.
• Earnings: Cooks are paid per session or per enrolled student according to the plan agreed with the platform. Earnings are credited to your wallet or Stripe Connect account.
• Conduct: Treat students with respect. Harassment, no-shows, or unprofessional behavior may result in suspension and forfeiture of pending earnings.
• Independent contractor: You are an independent contractor, not an employee. You are responsible for your own taxes and compliance with local law.

Fees, Payments & Escrow

• All payments are processed by Stripe. KreyòlDash does not store full card details.
• Customer payments are held in escrow and released to the restaurant (net of commission/fees) and driver only after delivery is confirmed.
• Registration fees are non-refundable. Subscriptions billed monthly or annually follow Stripe's billing terms; you can cancel anytime from your dashboard.
• Cooking Academy subscriptions, cook registration fees, recipe document purchases in the Recipe Gallery, and Play & Win game entry fees are also processed by Stripe and are non-refundable except as stated in their specific policies.
• Promo codes are subject to their stated terms and may be revoked if abused.

Cooking Academy, Recipe Gallery & Digital Content

• Cooking Academy: Students enroll in AI, live, or combined plans billed monthly via Stripe. Subscriptions can be cancelled anytime; access continues until the end of the billing period. Registration fees are non-refundable.
• Homework & photos: Students may submit homework photos per session. By submitting, you grant KreyòlDash permission to display your submission for review and, for final capstones, in the Recipe Gallery.
• Recipe Gallery: Students can author professional preparation documents with photos and publish them to the gallery, either free or for a set price. You retain ownership of your content and grant KreyòlDash a license to display and sell it on your behalf.
• Purchasing documents: When you buy a paid recipe document, payment is processed by Stripe and access is granted immediately. Because digital content is delivered instantly and cannot be returned, paid document purchases are non-refundable except where required by law or due to a verified platform error.
• Content rules: Documents must be your original work. Plagiarism, unsafe food advice, or prohibited content may result in removal and forfeiture of sales.

Account Deletion & Data

You can delete your account at any time from your profile. Deleting your account permanently removes your profile, loyalty points, driver, restaurant, or cook profile (and its menu items or documents), support tickets, reviews, notifications, and wallet history. Your past orders are anonymized so that restaurant and driver financial records remain intact. This action cannot be undone.

Prohibited Conduct & Suspensions

• Fraudulent orders, fake reviews, payment abuse, or chargeback abuse are prohibited.
• Harassment, discrimination, or unsafe behavior toward any user is prohibited.
• Restaurants, drivers, and cooks may not bypass the platform to avoid fees.
• Violations may result in warnings, suspension, fee forfeiture, or permanent removal from the platform.

Privacy

We handle your personal data as described in our Privacy Policy. We collect only what is necessary to operate the platform and process transactions.

Contact & Disputes

Questions, reports, or disputes can be raised through our support page. We will make commercially reasonable efforts to resolve disputes fairly and promptly. These terms are governed by the laws applicable where the platform operates.
