This section summarizes how local law in United States applies to your use of the platform. It is a summary, not legal advice, and does not replace the general terms above. Where local mandatory consumer law gives you greater rights, those rights are preserved.
- Governing law: These terms are governed by the federal laws of the United States and the laws of the state in which the restaurant partner is located, without regard to conflict-of-laws principles.
- Consumer protection law: U.S. federal consumer protection is enforced by the Federal Trade Commission (FTC); state consumer protection statutes may provide additional rights.
- Consumer protection authority: Federal Trade Commission (FTC) — ftccomplaintassistant.gov; state Attorneys General.
- Statutory consumer rights are preserved; our refund policy above applies for issues reported within 48 hours.
- Dispute resolution: Disputes may be resolved through binding arbitration or small-claims court as permitted by law.
1. How Payments Work
KreyòlDash uses Stripe to process all payments securely. When you place an order, the total amount is authorized on your card at checkout but not yet charged to the restaurant or driver. The funds are held in escrow until your order is delivered and confirmed. We never store your full card number — Stripe handles all card data directly.
2. What You Pay
The total at checkout includes: the food subtotal (set by the restaurant), a delivery fee (based on distance from the restaurant to your address), a platform service fee, a handling fee, applicable sales tax (based on the restaurant's location), and an optional driver tip. All charges are shown itemized at checkout before you pay.
3. Payment Methods
You can pay with any major credit or debit card through Stripe, or with your KreyòlDash wallet balance if you have topped it up. Both methods hold the funds in escrow until delivery is confirmed.
4. Escrow: Your Money Is Protected
When you pay, the funds are held in escrow — not released to the restaurant or driver yet. The restaurant receives their share only after your order is delivered. This protects you: if your order is never delivered or is significantly wrong, you can request a refund and the escrow funds are returned to your original payment method.
5. How Restaurants Get Paid
After delivery is confirmed, the restaurant receives the food subtotal minus a platform commission and a service fee. These fees cover payment processing, marketplace operations, and driver coordination. The net amount is sent to the restaurant's connected Stripe or bank account. Restaurants can track pending and processed payouts in their dashboard.
6. How Drivers Get Paid
After delivery is confirmed, the driver receives the delivery fee plus any customer tip. Earnings are credited to the driver's in-app wallet. Drivers can withdraw their wallet balance to their verified Stripe Connect account or bank account from their dashboard.
7. Refunds
If your order is never delivered, arrives significantly incorrect, or you are charged in error, you can request a refund within 48 hours through our support page. Approved refunds return the escrow funds to your original payment method via Stripe. See our Order & Refund Policy for full details.
8. Partner Fees
Restaurants pay a one-time registration fee and a monthly subscription (Basic or Premium) to be listed on the marketplace. Drivers and cooks pay a one-time registration fee before accepting deliveries or teaching sessions. These fees are non-refundable and are charged through Stripe at registration.
9. Disputes & Chargebacks
If you believe a charge is incorrect, please contact support first — we can often resolve issues faster than a bank chargeback. Disputes filed through Stripe or your bank are tracked on the order and reviewed by our team. Fraudulent chargebacks may result in account suspension.
10. Other Platform Services
Beyond food orders, KreyòlDash processes payments for: Cooking Academy subscriptions (monthly, cancellable anytime), cook partner registration fees, recipe document purchases in the Recipe Gallery (non-refundable once access is granted, except for verified platform errors), and Play & Win game entry fees. Each service follows the terms described in its specific policy and the Terms of Service. Partner payouts (cooks, restaurants, drivers) are processed via Stripe Connect or bank transfer after the applicable service is delivered.
